Cleversons Solicitors Fees

When you instruct Cleversons Solicitors in any area of law we may provide you with a quote of our fees or agree to work with you on a Fixed Fee Basis.  In addition to this we often work with Private Clients on a No Win No Fee Agreement, known as a Conditional Fee Agreement.  Please see below for specific fixed fees for some areas of Law which may be appropriate to your instructions to us.

All of the fees we charge will be clearly set out within our retainer with you or your Conditional Fee Agreement.

All of our fees are quoted on the basis of the following Fee Structure. 

Grade A or 1 (Solicitors and Legal Executives with over 8 years experience after qualification) – £267 per hour

Grade B or 2 (Solicitors and Legal Executives with over 4 years experience after qualification) – £229 per hour

Grade C or 3 (Other Solicitors, Legal Executives and staff of equivalent experience) – £165 per hour

Grade D or 4 (Trainee Solicitors, Trainee Legal Executives and other staff of Equivalent experience) – £121 per hour

We review the hourly rates in January each year and we will notify you of any changes in writing.

FIXED FEES STRUCTURES

Depending on your instructions our fees may vary from the sums set out below.  Instructions vary in complexity and all fees are based on the number of hours anticipated on your claim.  Where a fee differs from the fixed fees contained here we will explain why to you before accepting your instructions.

Contested £3000.00 Plus VAT (Plus Disbursements) for each Claim received against the estate.

Medium Estate upto £1.25m no more than 4 Bank Accounts, 6 Beneficiaries and 2 Properties and no over seas property. – 2.5% Plus VAT of the Total Value of Probate

Contested Probate £4500.00 Plus VAT (Plus Disbursements) for each Claim received against the estate.

Intestate Letters of Administration – 3% Plus VAT of the Total Value of Probate.

Contested £5000.00 Plus VAT (Plus Disbursements) for each Claim received against the estate.

Large Estate over £1.25, no more than 3 Properties in England and Wales, 5 Bank Accounts and 7 Beneficiaries – 3% Plus VAT of the Total Value of Probate

Contested Probate £6500.00 Plus VAT (Plus Disbursements) for the first Claim received against the estate. £250.00 per hour plus VAT thereafter for all other Claims where received.

Intestate Letters of Administration – 4% plus VAT of the total value of Probate.

Contested £7500.00 Plus VAT (Plus Disbursements) for the First claim received against the estate. £250.00 plus VAT per Hour thereafter for all other claims where received.

Personal Injury & Clinical Negligence

We undertake all of our Claimant Personal Injury matters on a Conditional Fee Agreement which means it is on a No Win No Fee Basis.  This firm charges, as a matter of policy, a 25% Success Fee to be taken from any recovered compensation, a full explanation will be provided when taking your instructions as there are certain aspects of your claim where the Success Fee does not apply, such as Future Loss of Earnings for example.  We also recover fees from the Opponent when successful with a claim.  In claims up to the value of £25,000.00 these fees are normally fixed fees. Such fees are set out in the Civil Procedure Rules at Rule 45.1 

Where a claim is valued at over £25,000.00 our fees are Claimed from the Opponent, on your behalf, at the following rates:

Criminal Injury Compensation Claims

We are unable to recover fees from the Criminal Injury Compensation Board, therefore our fees will be dealt with as a Success Fee.  Our Success fee will vary depending on the level of your claim and we may enter into either a Conditional Fee Agreement with you (if there is also a Civil Claim) or just a Damages Based Agreement.  Our Success Fee will be no less than, as a matter of policy, 25% of any recovered compensation.

Conveyancing

Please find below details of our Purchase Legal Fees, disbursements and other associated costs:

  1. Our Legal Fees cover the work required to complete your purchase, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (SDLT) if the property is in England, or Land Transaction Tax (LT) if the property you wish to buy is in Wales.
  2. Land Registry fee – We can advise on whether the on-line discount is available.
  3. Land Registry searches – This is £3 and if you are buying with a mortgage this will be an additional £2 per owner 
  4. Search fees on purchase of property. Typically around £300
  5. Bank Transfer fees of £30.00 plus VAT at 20% per electronic payment exceeding £25,000.00.
  6. Stamp Duty Land Tax on purchase of property. You can ascertain the amount here https://www.gov.uk/stamp-duty-land-tax/residential-property-rates
  7. In Leasehold cases, there may be additional charges payable to the Landlord or Managing Agent. We will not know these until we receive the Management information from the seller.

For the following cases:

  • New Build property:  please add £100.00 plus VAT at 20% to the Legal Fees above. In such cases, the postal scale of Land Registry fees will most likely apply.
  • Leasehold property:  please add £100.00 plus VAT at 20% to the Legal Fees above.
  • Shared Ownership: please add £100.00 plus VAT at 20% to the Legal Fees above.
  • Help to Buy Loans:  please add £100.00 plus VAT at 20% to the Legal Fees above.

 

The Transaction

For residential purchases we estimate 4-6 week from issue of contract to papers to achieve exchange of contracts, and 1-2 weeks after this to completion. 

However the transaction is dependent on factors which are outside of our control such as mortgage offers and the other parties in the chain.

The key stages involved in the transaction are:

  • Carry out ID checks, ensure finances are in place to fund purchase and instruct lender’s solicitors if needed
  • Receive and report on contract documents
  • Instruct and report on searches
  • Make any necessary enquiries of seller’s solicitor
  • Send final documents to you for signature
  • Exchange contracts
  • Arrange for all funds needed for completion to be sent to us
  • Complete purchase
  • Dealing with Stamp Duty Land Tax and registration.

Legal Fees for Sale

Please find below details of our Sale Legal Fees, disbursements and other associated costs:

  1. Our Legal Fees cover the work required to complete the sale, including repayment of any mortgage on the property.
  2. Copy title from the Land Registry £6 – £12 Freehold and £15-£21 Leasehold
  3. A fee for Bank Transfers of £36.00 per electronic payment exceeding £25,000.
  4. In Leasehold cases, any charges made by the Landlord or Managing Agent for provision of information. You should ask them to provide this information as early as possible.

The Transaction

  • Prepare contract documents and submit to buyer’s conveyancer
  • Respond to enquiries made by buyer’s conveyancer
  • Send final documents to you for signature
  • Agree completion date
  • Exchange contracts
  • Receive the sale monies from your buyer’s conveyancer
  • Complete the sale and discharge any mortgage payment and pay estate agents.

Legal Fees for Remortgage

Please find below details of our Remortgage Legal Fees, disbursements and other associated costs:

If you are looking to release equity from your home through a remortgage or refinance, then your mortgage company may require you to hire a conveyancer to handle the paperwork.

For remortgaging we offer a fixed rate of £650.00 plus VAT at 20%.

Other disbursements/associated costs which you will incur in the transaction include:

  1. Copy title from the Land Registry £6 – £12 Freehold and £15-£21 Leasehold
  2. Local Search (£100 – £150) or Indemnity premium (£12 – £40) dependent on the requirements of your mortgage lender
  3. Land Registry fee –
  4. £36 per electronic bank payment.

The Transaction

From start to finish it normally takes between four and eight weeks to complete the remortgage process.

The key stages involved in the transaction are:

  • When switching to a new lender, the new mortgage company may request that a solicitor carries out local searches, or they may accept a no search indemnity policy, and checks the title of your property
  • We will arrange for you to sign the Mortgage Deed
  • Once all searches and checks have been completed, the new lender releases the mortgage funds, and the solicitor repays the previous lender
  • The solicitor then updates the Land Registry.
